CURRENT SITUATION IN social and labor sphere.

According to solidarity pension system:

Social support to vulnerable populations:

Proportion of population with incomes below the subsistence minimum for the 1st quarter 2013 was 3.1% (urban areas - 1.5%, rural - 5.0%) and decreased in comparison with the same period in 2012 by 0.8 percentage points.

Targeted social assistance (TSA).

As of June 1, 2013 TSA assigned 50.8 thousand citizens with incomes below the poverty line in the amount of 608.2 million KZT.

The share of unemployed persons in the total number of TSA recipients is 6.6%, which is 1.2 percentage points less than the same period last year. The largest share of TSA recipients occupies children - 64.3%.

Special state benefits.

On June 1, 2013 special state aid covered, on average 1303.1 thousand people, compared to the same period last year, more than 1.0%.

Social support for mothers and children.

As of June 1, 2013 birth allowance received 160.2 thousand people, more than the same period in 2012 by 1.0%, thus, benefit costs amounted to 8.9 billion KZT.

To ensure the rights of disabled persons and their integration into society by local executive bodies covered about 96.3 thousand people with disabilities, or 87.6 % of total need. On the situation in the labor market.

IMPLEMENTATION OF THE PROGRAM OF EMPLOYMENT 2020.

In 2011, on behalf of the Head of State and is designed to July 1, 2011 launched the Program of employment 2020 (hereinafter - the Program), aimed at increasing the income of the population by promoting sustainable and productive employment.

The first direction of the Program of employment 2020 - "Education and employment assistance to citizens of the Republic of Kazakhstan and repatriates working age: underemployed, unemployed, self-employed, low-income; secondary school graduates 11 years of the current calendar year ; preserved disabled persons with disabilities; orphanages , orphans and children left without parental care under the age of twenty-three years, pensioners who retired before age generally established ; persons engaged in heavy work , works with harmful, osobovrednymi and / or dangerous conditions, are the recipients of special state benefits.

The second direction of employment programs - "Promoting entrepreneurship in rural areas."

   According to local authorities, on the 1st of June this year concluded 35,700 contracts with social willing to participate in the Program. Among them are unemployed - 26.6 million people (74.8%), self-employed - 7.0 million people (19.7%); low income - 1.6 million people (4.6%), 324 persons (0.9%) are classified as employees. With the proportion of young people under the age of 29 years is 51.6%, the proportion of women - 49.2%.

In the framework of the first vocational training program covered 37.4 thousand (33.5 thousand people. - Continuing with 2012, 3.9 thousand people. - a new reception in 2013).

The second direction of the Program 6.5 thousand people will be trained in the basics of entrepreneurship. This year, 8.5 thousand participants in the program will receive microcredit.

On the third direction of the Program is currently under construction and 339 individual residential buildings. As of June 1 of the current year completed the construction of 793 houses. Program participants and their families 768 inhabited houses.

In 2012 launched the fourth direction - "Development of rural areas" aimed at providing employment through the implementation of infrastructure projects in rural areas at medium or high potential for socio-economic development.

Within this framework, in 2013, provides for the implementation of 875 projects planned to create 13.9 thousand jobs.

ROADMAP EMPLOYMENT 2020.

Increase per capita income.

a) employed on an individual basis (inactive) in private farming production of goods for their own consumption, unpaid family workers regardless of the level of monthly income;

b) members of cooperatives engaged on an individual basis, in private farming production of goods for sale (exchange) with the level of monthly income below the subsistence minimum.

Order № 5.

Item 6: "Work out the organization, since 2013, a system of universal education workers based on labor legislation of the Republic of Kazakhstan."

- Suggestions for the Labor, Administrative and Criminal Codes of the Republic of Kazakhstan of liability provisions for deliberate provocation of labor disputes;

- Proposals for strengthening the administrative and criminal liability for inciting social hatred, coercion to strike late payment of wages, failure to comply with collective agreements and other offenses.

Under item 10: To avoid risks to labor rights violations designed a bill to amend and supplement the Labour Code of the Republic of Kazakhstan and the Law "On State Control and Supervision in the Republic of Kazakhstan ."

The points 11.12 : The draft new Criminal Administrative Codes included proposals to consolidate those responsible for deliberate provocation of labor conflict , forced to strike , delayed payment of wages, failure to comply with collective agreements and other offenses .

Thus, the Criminal Code is supplemented by a new kind of criminal liability - for acts provoking to continue participation in the strike is not lawful. Simultaneously, the Labor Code of the Republic of Kazakhstan is complemented material norm, sets the appropriate ban.

Administrative Code provides for specification of administrative offenses for violations of labor laws, delayed payment of wages, failure to participate in the negotiations on the collective agreement (contract), unjustified refusal to conclude a collective agreement (contract) , default or breach of the collective agreement (contract) etc.

Item 16: "To provide a comprehensive analysis of the law on trade unions and develop a bill on its completion."

In order to fulfill this request, the order of the Minister of Labour and Social Protection of 25.07.2012. № 300-m working group was established to develop a draft law "On amendments and additions to some legislative acts on the activities of trade unions and labor regulation."

Today, in the country there are more than 800 trade unions. The practice of most of them shows a lack of built system of trade union participation in social dialogue at all levels of social partnership, collaboration with employers.

In this context, the main objective of the bill is to define organizational principles of the trade union movement in order to protect the employment, social and economic rights and interests of workers, enhancing the role of trade unions in social partnership.

The bill provides for trade unions to build a membership (the association) at the appropriate level of social partnership, to determine the status, purpose of trade unions in the social partnership, their responsibility for decisions obligations under the agreements negotiated collective agreements and decisions. Legislate requirements to the statute of the trade union, their rights and obligations established in the regulation of mandatory collective bargaining issues learning the basics of workers labor legislation of the Republic of Kazakhstan.

Trade unions made ​​a duty explanatory work among its members to improve their legal literacy, including the basics of labor law, the development of skills and negotiating skills to achieve consensus in labor disputes.

The bill provides for the consolidation of trade unions and their associations responsibilities for the performance of the collective agreement, sectoral, regional, general agreements. There will also be strengthened control over the implementation of collective agreements.

Advancing the bill in accordance with the Plan of Legislative Work of the Government of the Republic of Kazakhstan for 2013 (May - Ministry of Justice, July – Government, September - Majilis).

Item 25: "Since 2014, ensure the development of five-year forecasts for the labor market."

Was created under the Ministry of the relevant working group (order № 302-m from Minister date from 25.07.2012.).  Comprising members of the Majilis, government representatives, employers, trade unions and scientific organizations.

One of the main conditions for the qualitative prediction of the labor market is to assess the status and prospects of the development of human resources, the determination of the need for them and provide sources through the development of the balance of labor resources (hereinafter - BLR).

BLR is necessary for monitoring the use and planning management activities (distribution and redistribution) labor in cases of imbalances in the labor market.

In order to evaluate, improve the efficiency of the processes of formation, distribution and use of human resources for the Ministry of LLP "Kazakhstan Forecast" developed a method for reporting and predictive BLR Republic of Kazakhstan.

The information-analytical system is installed on the hardware and the staff of the Ministry of JSC "Information-Analytical Center on employment issues", trained users to build BLR.
