Measures to achieve indicators of direct results

 

1. To develop the system of social maternity and childhood support on the ground of:

1) improving legislation on assigning and making social payments from the SFSI in the event of revenue loss due to childcare upon reaching 1 year old;

 

 

 

 

 

 

 

 

2) developments and proposals to consider by the RK Government:

on amending and adding terms of assigning social benefits to families with children (transition to conditional payments);

increasing benefits for children aged under 18 from underprovided families by optimizing other types of social payments.

RK Law project “On introducing amendments and additions into some legislative acts of the Republic of Kazakhstan regarding social security” has been developed and suggests additional standards providing improvement of rights of participants of the system of obligatory social insurance (with aim to increase average monthly income of a participant of the system of obligatory social insurance while assigning social payments from the SFSI on all types of social risks, month of social risk is not included in the period liable to accounting).

At the present time the law is under consideration of the RK Parliament Senate.

16 November 2012 witnessed signing technical task to research “Improving social aid and support system” in the scope of JERP (Joint Economic Research Program). Project implementation period: November 2012 – June 2013.  The research showed that concrete offers to introduce conditional monetary assistance in Kazakhstan would be provided in the second half-year 2013.

 

 

2. Increasing the rate of public family benefits

Taking into account expected inflation level for 2012 the volume of benefits has increased by 7% confirmed by macroeconomic indicators forecast.

 

 

3. To broaden coverage of working women in social insurance system (due to risks of loss of income owing to pregnancy, childbirth  and child care upon reaching 1 year old)

In the reporting year certain measures were taken with aim to increase awareness and broaden coverage of social insurance system (public awareness campaign in regions of the country; round table on “Issues of control for timely and full payment of social assignments by self-employed people”; participation in meetings in association with the RK Trade Unions Federation, ILO, HEI representatives, etc.

Also broadening coverage of working women in obligatory social insurance system was considered in the scope of inventory of social legislation, developed proposals have been sent to MEDT.

According to this indicator Kazakhstan moved from 19 to 24 position saving competitive advantage in Labor Efficiency subindicator which improved its position from 21 to 19 position in 2012.

It is necessary to mark the following positive tendencies noticed within society.

Number of busy women is growing in the structure of economically active population. Now it makes up 4.1 million women. In the scope of the territories development programs for 2012, 113.2 thousand people (about 59.8 %) out of 189.3 thousand women addressed to employment bodies have been employed in constant workplaces. 

Measures have been taken to increase competitiveness of women in labor market within the Employment Program 2020.

In February of that year amendments and additions in the Labor Code have been made, including in fixing distant employment.

On 16 November 2012 Law of the Republic of Kazakhstan No. 50-V “On ratification of the Convention on equal treatment and equal opportunities for working men and women: workers with family duties (Convention No. 156)” was adopted. The ministry developed Actions Plan to improve position of GCI of WEF on estimate indicator “Labor market efficiency”  approved by E. Orynbayev Deputy Prime Minister of the RK. In regard to GCI of the WEF indicator failure it is also necessary to consider operating method of their determination (main source of information while making rating is the results of survey of companies heads which make up 70% of common used data while assessing results of rating and have more subjective character).

 

Objective 2.1.1. To increase the quality of labor resources

Failure is caused by considerable reduction of financing the professional training in the scope of territories development programs by local executive bodies. Nobody from the addressed in Aktyubinsk region was referred to training. Also in the scope of Employment Program 2020 63,2 thousand people were referred to training.

4. To stimulate in-house personnel training and retraining

In order to stimulate in-house personnel training and retraining, organizations may conclude an Agreement with employers that employer shall pay for training of some participants of Employment Program 2020 with further employment and liability of an organization to compensate employers for training cost but no more than 70% of expenditure sum provided by organizations for this aim. 

In 2012 the number of workers trained at the expense of an employer made up 400.4 thousand people.

It is necessary to note actual value of the number of youth involved in Employment program 2020 does not take into account the number of its participants continuing training since 2011. If this category is taken into account indicator (coverage by the Employment program) will be overachieved.

1. To implement main directions of the Employment Program 2020:

–     to train and assist in employment the self-employed, unemployed and underprovided population;

–     to assist to entrepreneurship development;

–     to increase mobility of labor resources.

For professional education 15 894.2 million KZT was allocated from republican budget in 2012.  

15 368.7 million KZT was spent for the reporting date and made 96.7% of annual amount.

Professional training is carried out in 426 education institutions.

In total training covered 63 154 people (100% of  plan).

In 2012 298.4 million KZT was allocated for teaching entrepreneurship basics and 291.4 million KZT (97.7% of sum per year) was spent.  

6 256 people have learnt entrepreneurship basics (108.6% of plan)

Total amount of funds allocated for micro-crediting is 12 368.3 million KZT. According to LEB (Local Executive Bodies)  data, number of people receiving microcredit at the expense of funds allocated for micro-crediting made up 6 572 people in 2012.

4558 people out of the number of microcredit receivers set up own business.

In 2011 – 2012 in the scope of the third direction “Increasing labor resources mobility” it was aimed to build 1085 houses with 4296 apartments. Among them 1002 individual apartment houses, 83 apartment buildings.

764 houses (2763 apartments) have been built by 1 January 2013.

Participants of the Program and their family members moved into 661 houses (2184 apartments) or 86.5% of houses put into operation.

356 houses (1586 apartments) are being built.

 

2. To form institutional employment service facilities

Resolution of the RK Government No. 1772 dated 29 December 2012 “On amendments and additions to some decisions of the Republic of Kazakhstan Government” introduced measures in EP 2020 intended for improving institutional employment service facilities.

 

3. To increase awareness of the people on population employment issues

Since the beginning of 2012 periodical press on regular basis has published news, information and analytical materials on the process of implementing the Employment Program 2020.

According to monitoring data since the beginning of 2012 republican TV channels have broadcasted about 861 plots and periodical press has published 863 articles.

Among the print media dealing with this direction it is to outline the newspapers as Kazakhstanskaya Pravda, Yegemen Kazakhstan, Strana i mir, Liter, Aikyn, Express-K, Izvestiya Kazakhstan, Alash ainasy, Zan gazeti, Kazinform and Bnews news agencies, etc.

Yegemen Kazakhstan and Kazakhstanskaya pravda newspapers published articles on Employment Program  2020 under specialized headings “National issue”, “Results of your profession”, “New social turn”, “Numbers and Facts”, “Margin of safety”, “Regions”, “State of villages” and under special pages “Government”, “Employment”, “Society”.

Measures to achieve indicators of direct results

1. To improve monitoring and forecasting of demand and supply in national labor market; to develop the balancing of labor resources.

By order of the Ministry, Forecast Kazakhstan LLP has developed methodology to make reporting and forecasting balancing of labor resources of the Republic of Kazakhstan.

Starting from 2014 the Ministry will develop forecasts of labor market development for five years on the ground of balancing labor resources.

 

2. To improve population employment legislation regarding activation of working age persons

Law No. 64-V dated 8 January 2013 “On introducing amendments and additions to some legislative acts of the Republic of Kazakhstan regarding optimization and automation of socially important public services” has been adopted.  

 

 

3. To render national support for persons referred to social workplace, public work, youth practice in the scope of the Employment Program 2020 and regions development programs

With aim to employ participants of the Program in social workplaces in regions of the country contracts have been concluded with 6.1 thousand employers and according to that 27.6 thousand people have been employed. Average monthly wage of employed participants of the Program made up 44.8 thousand KZT.

5 489.5 million KZT was allocated and utilized for financing public work.

Number of organizations, contracts to organize youth practice was concluded with, made up 8.0 thousand. 24.9 thousand graduates of educational institutions or 156.8% of the plan have been employed to youth practice.

 

4. To increase mobility of labor resources by supporting moving from rural settlements with low economic potential to rural settlements with high economic potential and centers of economic growth

Program participants and their family members moved into 661 houses (2184 apartments) or 86.5% of houses put into exploitation.

1. To improve legislation on population migration in managing labor migration

In order to implement order of the Head of State dated 27 January 2012 on automating authorizing documents (procedures), the RK Government approved resolution regarding introducing permission issue automation to attract foreign labor force (dated 25 January 2013 No. 44).

 

 

2.    To develop proposals to set quota for attracting foreign labor force

In accordance with proposals of state bodies for 2013 quota is set in the amount of 1.2 per cent to economically active population of the republic that makes up 108.1 thousand units (in 2012 – 1.0% or 90.0 thousand)

 

 

3.    To control employers to follow special terms of attracting FLF

In 2012 employers, attracting foreign workforce, created 29855 workplaces, retrained 5079 Kazakhstan citizens, carried out professional development of 21773 local workers, 13184 Kazakhstan workers completed professional training and 1904 foreign specialists were substituted by Kazakhstan personnel.

 

 

4.   To create system of accounting and information support of processes of labor migration

At the present time information system “MFLF” is operating. 

Also the RK MLSPP works on putting into operation AIS “FLF”.

Moreover in order to automate business processes, the Ministry adopted Actions Plan on automating business processes, reducing number of documents required from population while submitting authorizing documents “Issue, reissue, prolongation of permission to attract foreign labor force to carry out labor activity in the territory of respective administrative-territorial unit” for 2012.

1.    To improve monitoring of labor security and protection state in industrial sphere

In order to improve monitoring of labor security and protection and also industrial traumatism, monitoring of 323 thousand large enterprises covering 500 thousand people is ensured on monthly basis.

 

 

2.  To develop national and to adapt international labor standards. To support its introducing in economy sectors

In accordance with Decision of Customs Union Commission dated 9 December 2011 No. 878 technical regulation “On individual protection means security” was adopted and came into force on 1 June 2012.

At the present time there is the work on reconciling project of the Program to develop (introduce amendments, reconsider) intergovernmental standards and applying that results in following requirements of technical regulation  of Customs Union “On individual protection means security”. 

In this regard, on the ground of expert conclusion of RSE “Kazakhstan standardization and certification institute” in 2012 it is recognized to be unreasonable to develop earlier planned standards in the sphere of labor security and protection which developer was RSRILP.

Work on developing and reissuing standards according to State Standard will be continued after adopting above mentioned program.

 

 

3. To develop and implement (on trilateral basis) measures to reduce number of workers including women involved in harm and dangerous labor conditions

29 December 2011 witnessed concluding General Agreement  for the period 2012 – 2014 and in scope of that the RK Government, republican associations of employees and republican associations of employers undertook for solving questions of labor security and protection and ensuring safe labor conditions for workers

During General Agreement period on the constant basis parties will hold consultations on questions regarding financing the measures intended for reducing industrial traumatism and professional morbidity rate, educating to labor protection.

Analogous regulations are set by trilateral sectoral and regional agreements.

Also amendments to Labor Code adopted in the current year created joint commissions on labor protection, including representatives of employees and employers on the principles of social partnership, in the system of enterprises internal control department.

Commission objectives are the following:

- to develop joint actions of employers, labor unions and (or) other employees authorized representative bodies on ensuring requirements of labor protection, preventing industrial traumatism, professional diseases on the ground of proposals;

- to organize controlling of labor conditions and protection status in workplaces, to prepare relevant proposals to an employer to solve the problems of labor protection on the basis of analysis of labor conditions and protection status, industrial traumatism and professional morbidity;

- to inform workers about labor conditions and protection status in workplaces, existing risks causing danger to health and compensations supposed for employees for work in harmful and (or) dangerous working conditions, individual protection means.

In this regard, all taken actions will be directed on gradual lowering of the number of employees working in harmful and dangerous industrial conditions

 

 

 

4. To develop methodology of earlier finding risk groups and to prevent professional diseases

5. To change insurance rates according to classes of professional risk

In the scope of scientific and reserach work "Assessment of economic losses due to industrial traumatism and occupational diseases in different branches of economy of the Republic of Kazakhstan" there is the work on developing the method of calculating economic losses due to professional traumatism and occupational diseases in respect to specifics of light and food industry, trade and public catering, agrarian and social sectors of economy of the RK and also recommendations and suggestions to improve operating mechanism of insurance protection against accidents and also on introducing amendments and additions into respective legislative and regulatory legal acts of the Republic of Kazakhstan in referring type of economic activity to classes of professional risk.

 

 

 

6. To expand coverage of workers by the system of employee obligatory insurance against accidents while performing labor (service duty).

Since the beginning of 2012 the SLI of territorial departments of the Committee has organized 969 performances in republican and regional mass media to explain labor and social legislation.

SLI territorial bodies organized 3339 seminars and trainings.

In the scope of inspections held by SLI there is the work on checking conclusion of contracts of workers obligatory insurance.

In total inspectors of the SLI made 1726 inspections in 2012.

 

 

 

7. Social support of persons for damage caused to life or health, laid by judge on the state in the event of stopping of juridical entity operating

There is quarterly monitoring of activities of the CPPC and its territorial departments, the Ministry lower organizations on claim-related work (including compensating harm caused to life and health)

Territorial departments take part in courts on 870 civil cases (as a claimant – 431, as a respondent – 439) including on 013 program – 78. Among them, 73 have been considered with participation of territorial bodies.

 

 

 

Objective 3.1.2. To prevent and suppress violations of labor legislation

Rules of involving employers in the pilot project of declaring activities of employers to follow labor rights of workers have been developed and agreed with “Atameken Union” Kazakhstan National Economic Chamber and Federation of Labor Unions of the Republic of Kazakhstan.  

It is planned to adopt the project by joint trilateral decision of parties of social partnership.

In 2012 scientific and research work on “Research and development of scientific and methodological basics of managing labor protection to ensure technically achievable, economically and socially justified minimum permissible professional risk” is continuing.

 

 

2. To monitor arrears of wages, to take measures to liquidate and prevent its formation

The ministry carries out weekly monitoring of arrears of salary and takes measures for its liquidation with the Prosecutor General’s Office, regional anti-crisis headquarters.

Overdue (over 3 months) debt of salary across the republic was reduced from 1.4 billion KZT as of the beginning of 2012 to 1.1 billion KZT as of 1 January 2013.

 

 

3. To form and fulfill Joint Actions Plan to liquidate the worst forms of child labor for 2012 – 2014

In the scope of “Programs on worthy work in the Republic of Kazakhstan for the period 2010 – 2012” on 30 April 2012:

Joint actions plan on elimination of the worst forms of child labor and implemention of Convention of the International Labor Organization No. 182 in the Republic of Kazakhstan for the period 2012-2014, defining the main priorities of policy on liquidating the worst forms of child labor, was approved and is in the process of implemention.

In order to improve legislation of the Republic of Kazakhstan, in February 2012 amendments were made to the Labor Code providing duties of an employer to support maintaining registers and other documents surname, name, middle name and date of birth of workers under 18 years old specified in.

According to the results of 10th meeting (on 25 May 2012) of the National Coordination Council on fight against the worst forms of child labor (hereinafter referred as the Council) operating under the Ministry of Labour and Social Protection of Population, National information campaign "12 days of fight against exploitation of child labor" was held during the period 1 - 12 June 2012.

Results of national information campaign are the following:

69 press conferences, 151 round tables, about 2500 competitions, discussions, seminars, trainings have been held;

more than 300 explanations have been held via hotline and in counseling offices;

145 articles have been published and over 130 transmissions to mass media on conducting the NIC have been organized.

In total actions of National information campaign covered over 1,5 million children and 102 thousand adults.

At the present time according to results of work of the working group formed by the Ministry of Education and Science, representatives of the Ministry of Internal Affairs and Prosecutor General's Office, amendments have been introduced into order of the Minister of Education and Science No. 468 dated 28 August 2012 No. 398 regarding admission of foreign children and stateless persons permanently living in the Republic of Kazakhstan (refugees, persons looking for shelters, consular officials, employees of diplomatic institutions, labor migrants working in the Republic of Kazakhstan according to the migration legislation) to educational institutions to obtain preschool, primary, main secondary and general secondary education.

State labor inspectors carry out permanent explanatory work on preventing the worst forms of child labor during inspections of individual entrepreneurs, farm household dealing with agricultural job.

 

 

4. To increase effectiveness of public awareness campaign on following labor legislation

Since the beginning of 2012 SLI of territorial departments of the Committee organized 969 performances in republican and regional mass media to explain labor and social legislation.

SLI territorial bodies organized 3339 seminars and trainings.

Presented report contains the comparative (contrastive) analysis of the scheduled results and their execution. In addition the analysis has been done on the ground of official documents and interview carried out by a consultant of the ILO with all signed this document parties of social partnership.

 

 

2.  To stimulate increase of corporate social responsibility.

On 25 December 2012 the Palace of independence in Astana held celebration of winners of competition on social responsibility of business "Paryz".

This action is organized by initiative of the Head of state and is considered to be one of the significant measures of stimulating subjects of private business to solve social problems, demonstrate and spread widely positive experience.

Winners of competition received respective diploma and distinctive emblem.  The companies will also acquire the right to use emblem with advertizing purposes within two years after awarding with this rank.

Number of participants of competition in 2012 made up 525 enterprises from all regions of the country. JSC KazTransOil was honored with Grand Prix. The company financed the building of social facilities with total amount of 4.1 billion KZT. The company rendered sponsor (charitable) support with total amount of 2.6 billion KZT. Distinctive achievement of the company is the implementation of the National IPO Program intended to ensure equal opportunity for population to purchase stocks of domestic companies.

 

 

3. To conclude General Agreement among the Government, employers associations and employees associations for the period 2012 – 2014

In 2012 there were meetings of the Republican trilateral commission on social partnership and regulation of social and labor relations (hereinafter referred as the RTC) (on 6 April and on 7 May 2012) and meeting on prevention of labor conflicts and activities of the RK labor unions on 17 September under the chairmanship of the Prime Minister of the Republic of Kazakhstan. 

In the scope of taking measures on regulating social and labor relations provided in the General agreement, the Complex plan on preventing social tension and solving social and labor conflicts has been developed and adopted (by RGRK (resolution of the government of the RK) dated 12 November 2012 No. 1295d restricted).

The plan includes measures intended for conducting continuous monitoring of social tension in regions by authorized bodies on labor and social protection and akimats, improving legislation concerning prevention of social and labor conflicts, enhancing the role of social partnership in preventing labor conflicts and conducting public awareness campaign on all levels of social partnership.

The ILO Conventions No. 183 “On maternity protection” (LRK dated 14 February 2012 No. 554-IV), No. 156 “On equal treatment and equal opportunities for men and women workers: workers with family duties” (LRK dated 16 November 2012 No. 50-V) have been ratified in the scope of introducing international labor standards.

Coordination procedures on ratification of the ILO Conventions No. 95 “On salary protection” and No. 26 "On creation of procedure of setting minimum salary" are carried out.

Moreover, materials on Kazakhstan joining the ILO Convention No. 187 “On labor protection management system” to the meeting of the Interdepartmental Commission on cooperation with international organizations of the RK Ministry of Foreign Affairs have been prepared.

The Joint plan of work on eliminating the worst forms of child labor for the period 2012-2014 determining the main priorities of policy to liquidate the worst forms of child labor has been adopted and is in the process of implementation.

The ministry developed the project of new model of civil servants labor remuneration system on the ground of necessary researches.

Taking into account international experience of organizing remuneration of workers of budgetary sphere, main components of the project on new model of civil servants remuneration system are the following:

1) new register of positions with accurate criteria of referring positions of civil servants to functional blocks depending on complexity, volume and specifics of performed work, educational level and professional qualifications of workers.

2) new scale of coefficients, separately each functional block in the perspective of branches which will stimulate career and professional growth of civil servants.

3) optimization of the system of additional payments and markups. Operating system of additional payments and markups was divided in compensating and stimulating payments. They will be used to establish dependence of workers on working conditions (compensating additional payments) and/or to serve as reward for great achievements at work (stimulating markups).

Also in the offered model of civil servants labor remuneration system it is offered to remunerate by results which will depend both on the results of each worker separately and on the final results of organization activity in a whole.

Calculations for determining additional need of budget funds on implementation of the new model of civil servants LRS as of 1 September 2012 have been made, summary information is provided to the RK PMO and the RK AP.

Committee on control and social protection, the RK Finance Ministry and SFSI approved Actions Plan on information exchange of timely and full transfer of social assignments and obligatory pension contributions by payers in order to enhance management of the system of obligatory social insurance.

Since 1 January 2012 due to increase of the volume of monthly estimated index the amount of assigned social payments for care of a child under one year old from the SFSI has been automatically increased to the level of similar state benefit from state budget. During 2012 the amount of additional payment increased to the amount of similar state budget made up 8.1 billion KZT.

At the same time, analysis of the assigned social payments from the SFSI according to data of IAS of the SFSI is regularly carried out. By SFSI letters dated 09 November 2012 No. 17/2230 and dated 12 November 2012 No. 17/2232, the Committee on control and social protection received results of analysis concerning assignment of social payments for maternity and chilbirth from the SFSI on the ground of social assignments which have been trasferred right after social risk emerging and adding to the assigned amount of social payments from the SFSI.

In the scope of implementing the Program on worthy work in the RK for 2010-2012, the Ministry in association with the International Labor Organization completed the work on researching questions of enhancing method of determination of poverty line (hereinafter referred as the PL), taking into account international experience and opportunities of Kazakhstan.

Moreover, in the scope of the state social order, Research Center JUPITER LLP completed research of opportunity to apply in Kazakhstan the median income as a criteria of rendering social support to population.

The Ministry held meeting of the round table to discuss questions of enhancing method of determination of the PL on 29 January 2013.

Round table participants are Deputies of the RK Parliament Majilis, representatives of the Ministries of Economy and Budget Planning, Finance, Health Care of the Republic of Kazakhstan, Agency of Statistics of the Republic of Kazakhstan, PA “Kazakh Academy of Nutrition”, representatives of Federation of Labor Unions of the RK, experts of the International Labour Organization.

According to the results of discussion the method of determining the volume of the PL used in the Republic of Kazakhstan, has been recognized to correspond to international requirements, and also it is found as unreasonable to apply median income in Kazakhstan for setting line to render social support as it is applied mainly for country assessment and comparing the level of poverty for calculating the method of relative poverty.

According to the results of the round table recommendations to enhance the method of determining value of the PL have been elaborated and will be considered with the interested government bodies.

 

 

2. To optimize types of social payments from local budget

Beginning of the current year was the start of work in regions to bring in line the rules of rendering social support regarding establishment of common volume of social support for holidays and memorable dates.

4 pilot regions have been defined (Astana, East Kazakhstan region, Kostanay region and Pavlodar region) to implement the new mechanism of optimizing provision of social payments to certain categories of citizens.

Moreover, in 2012 the Ministry made amendments and additions to the Law of the Republic of Kazakhstan "On local public administration and self-management in the Republic of Kazakhstan" regarding determination of maslikhats and akimats competence to approve and develop rules of rendering social support, set the volume and determine the list of certain categories of citizens in need.

Ministry has developed the draft of Standard rules (hereinafter referred as the Rules) on rendering social support, establishing the volume and determining the list of certain categories of citizens in need and at the same time Standard regulations on special commissions coordinated with local executive bodies and which at the present time pass established procedures of agreement.

Rules have been developed in order to regulate provision of social support at the expense of means of local budget to certain categories of citizens in need according to the decision of maslikhats of city of republican importance, capital, region (city of regional importance) (hereinafter referred as the social support), and also in order to maintain their standard of living, establish economic, social and legal guarantees on receiving social support, targeted and rational use of budgetary funds.

  a) low rehabilitation potential of disabled people which shows growth of number of disabled people of 1-2 groups. In 2011 severety of disability (percent of for the first time recognized disabled people of the first and second group) made up 64%, in 2012 - 67.5%.

 b) changes in the legislation, at the beginning of the current year the resolution of the Government of RK No. 1241 dated 31 October 2011 "Rules of evaluating temporal disability, outputting list and certificate on temporal disability" came into effect and according to that organizations of health care have the right to prolong (without MSE) medical certificate for long period (until health recovery). If earlier patients with injuries were referred to MSE of disability establishment (within certain time after conducting rehabilitating measures, they are rehabilitated), now the patient has disability list until complete recovery of working capacity. Patients only with heavy forms of diseases, impossibility of rebalancing disordered functions are referred to MSE.

- 25 July 2012 - the RK MLSPP took part in the work of advanced training courses for social workers carried out by scientific and practical center “Alsem – Astana” and gave explanations on the current legislation regarding special social services.

 -  On 14 June 2012 a representative of the RK MLSPP took part in the conference of BOTA foundation and UN Children's Fund (UNICEF) “Steady strategy of effective social services for children and youth from underprovided and vulnerable groups in Kazakhstan” and made report on the subject “Children and youth with special needs”.

 - 13-14 September 2012 - Semei held seminar on "Enhancing institutional opportunities of local executive bodies in developing the programs on deinstitualization of medical-social institutions" organized by the RK MLSPP with assistance of the UNDP and Department on employment and social programs coordination of the East Kazakhstan region.

14 August 2012 - senior secretary of the Ministry of Labor and Social Protection of Population of the RK approved the Actions Plan on developing hearing aid, where it is planned to increase the number of persons with hearing disorder to be rendered by hearing aid, and also extending the List of services provided by RSE Republican Center of Hearing Correction by 2015.

In 2012 analysis of ensuring disabled people with prosthetic-orthopedic means was carried out, suggestions to improve branches were worked out. According to contract on public purchases dated 14 May 2012 No. 88 RSE RCEP researched the development of prosthetic and orthopedic branch in the Republic of Kazakhstan.

In 2012 the MLSPP RK developed the project and ensured adopting the resolution providing approval of new standards of public services of local executive bodies and the Ministry, introducing amendments in operating register and standards (“On introducing amendments and additions to some decisions of the Government of the Republic of Kazakhstan” dated 17 August 2012 No. 1059).

2. In the scope of implementing the Actions Plan on optimizing business process, reducing the number of documents requested from population while receiving state service “Assignment of benefits for childcare and childbirth”, the Minister of Labor and Social Protection of Population of the Republic of Kazakhstan dated 28 March 2012 No. 100-o-m, the Minister of Justice of the Republic of Kazakhstan dated 03 April 2012 No. 137 and the Minister of Transport and Communications of the Republic of Kazakhstan dated 09 April 2012 No. 162 have approved the joint order “On the organization of pilot project on rendering electronic public service”.

Also order of the Minister of Labor and Social Protection of Population of the Republic of Kazakhstan No. 149-o-m dated 20 April 2012 approved Methodological recommendations on rendering electronic public service “Assignment of benefits for childbirth and childcare” in assigning benefit for childbirth via “e-government” web portal in the scope of pilot project”.

Since 23 April 2012 RSE SCPP has been implementing pilot project on rendering electronic public service “Assignment of benefits for childcare and childbirth” in assigning benefit for childbirth firstly in Astana city and Shortandy district of Akmolinsk region and then across the republic in Q4.

In Q4 2012 (on 19, 30 October, 20 November and 10, 20 December of that year) there were presentations of rendering public service “Assignment of benefits for childbirth and childcare” regarding childcare allowance in electronic format.

At the present time the work on this direction is continuing.

3. A representative of Social Assistance Department (Sh.S. Zhakitova) delivered lecture on “Order of assignment of social payments to families with children” in PI “Advanced training courses of personnel of the Ministry of Labor and Social Protection of Population of the RK” for specialists of pension and benefit assignment offices of territorial departments of the MLSPP RK.

According to the approved diagrams of the MLSPP, in total 337 employees were liable to training in 2012. According to the results of the year 429 employee of the Ministry have been trained, including 389 people of territorial bodies.

4. In 2012 all information systems of the MLSPP were certified on following the requirements of information security, including AIS “Social assistance: TSA, SCA”, and were introduced in industrial exploitation.

1. In 2012 the MLSPP RK developed the project and ensured accepting the resolution providing approval of new standards of public services of local executive bodies and the Ministry, introducing amendments in operating register and standards (“On amendments and additions to some decisions of the Government of the Republic of Kazakhstan” dated 17 August 2012 No. 1059).

2. The law “On amendments and additions to some acts of the Republic of Kazakhstan regarding optimization and automation of socially significant public services” has been developed to introduce amendments providing improvement of standards of rendering public services on assisting to population employment, accessibility and improvement of the quality of provided public services in questions of population employment, also in electronic format.

3. In 2012, 132 SLI of territorial Departments of the Committee had training courses in PI “Advanced training courses of personnel of the MLSPP RK” on “State supervision and monitoring over following the requirements of labor legislation of the RK”.

4. In order to implement the Program, 204 population employment centers have been created directly on places which receive citizens expressed willing to take part in actions of the Program.

5. In 2012 all information systems of the MLSPP were certified on following the requirements of information security, including AIS “Labor market”, and were introduced in industrial exploitation.

 

Strategic direction 3.

 

Ensuring realization of citizens labor rights

 

Aim 3.1.

To protect labor rights and improve conditions of labor security and protection  

1. Professional development of employees of the State Labor Inspection (hereinafter referred as the SLI) on labor questions, questions of labor protection and security on the basis of RSE “Advanced training courses of MLSPP employees”

1. On the basis of RSE RSRILP there are advanced training courses for heads of organizations and persons responsible for labor security and protection in enterprises.

Within 2012 the Institute and its branches have carried out 145 courses, trained 458 persons responsible for labor security and protection in enterprises.

2. In the scope of the Program of operations on interstate standardization for the period 2010-2012, reissue of standards according to State standards is being carried out, in this regard on the ground of expert conclusion of RSE “Kazakhstan Institute of Standardization and Certification” it is found to be unreasonable to develop earlier planned standards in the field of labor security and protection which developer is the RSRILP.

3. In 2012 all information systems of the MLSPP were certified on following the requirements of information security, including AIS “Labor protection and security”, and were introduced in industrial exploitation.

1. In 2012 the MLSPP RK developed the project and ensured accepting the resolution providing approval of new standards of public services of local executive bodies and the Ministry, introducing amendments in operating register and standards (“On amendments and additions to some decisions of the Government of the Republic of Kazakhstan” dated 17 August 2012 No. 1059).

2. In order to ensure access and improve the quality of public services on social security, in the current year amendments have been made to Register of public services and according to that 7 services of the MLSPP have been handed to the PSC on alternative basis, and 1 service – completely. Moreover, Plans on optimization, approved by E.T. Orynbayev Deputy Prime Minister, are being implemented in order to convert services of the MLSPP to electronic format.

The report on implementation of the Plans is monthly provided to the MTC RK. Operations on the development and approval of STD, and also on integration interaction are being conducted. 

In addition, in order to ensure access and improvement of the quality of public services on social security, operations to convert public services to electronic format were carried out in 2012.

3. At the present all pension and social payments have been automated.

4. Within 2012 62 experts have been trained to assignment of pensions and benefits of territorial departments on “State provision of pensions and benefits”, “System of social protection of population, quality of rendering public services regarding assignment of pension and social payments from the SCPP”.

5. In 2012 all information systems of the MLSPP were certified on following the requirements of information security, including AIS “Contact-center”: SCA, TSA”, “e-social security”, and were introduced in industrial exploitation.

Formation of effective system of social support to vulnerable categories of citizens

In 2012 the MLSPP RK developed the project and ensured accepting the resolution providing approval of new standards of public services of local executive bodies and the Ministry, introducing amendments in operating register and standards (“On amendments and additions to some decisions of the Government of the Republic of Kazakhstan” dated 17 August 2012 No. 1059).

2. Public social order has been placed among nongovernmental organizations to train social workers in the amount of 6 million KZT. 24 July 2012 was the day of concluding the contract with "Ulagat" public association. In the scope of public social order, about 200 specialists of the system of social service had training in September-November of that year.

3. In 2012 all information systems of the MLSPP were certified on following the requirements of information security, including AIS “e-social security”, and were introduced in industrial exploitation.

 

Applying information and communication technologies

3) in the volume of IT equipment sector (2011 – 1.5%, 2012 – 2.2%, 2013 – 3.1%, 2014 – 4.1%, 2015 – 4.5%);

8. To consider possibility of applying “IT outsourcing” for the Ministry information systems.

1. According to actual order “On some questions of information security of the Ministry of Labor and Social Protection of Population of the Republic of Kazakhstan” (approved on 27 August 2012 No. 343-o-m), structural subdivisions held explanatory campaign. Heads monthly receive information on the results of analysis of the report of JSC IAC on EP on information security.

 2. The contract dated 2 May 2012 No. 237/05 concerning certification of information systems of MLSPP RK (UISSLS and AIS SCPP) has been concluded with RSE CTSAT. In 2012 all information systems of the MLSPP were certified to meet the requirements of information security and put in industrial exploitation.

3. At the present time business process of creating the model of business and assigning pension payments and social benefits is implemented in the IS “E-model”.

In 2012 operation was held to convert social payments from the SFSI to e-model of social payments, in particular automation of costing of calculations, implementation of electronic card of a receiver of the payment.

Operation of modernization of “E-model” is proceeding.

4. Workers of information contact-center, established on the basis of RSE SCPP, have been rendering services (consultations on different questions of rendering state services) since 2011.

At the present time IC (information center) Contact-center gives consultations on social payments on three interfaces (telephone communication – 1411 - common free number, e-mail, SMS message on vacancies in the requested human settlement, WEB, WAP portals). In 2011 over 46 thousand citizens addressed for information to contact - center, in 2012 the number of the addressed reached 105 thousand.

5-6. During the period from 2011 to 2012, 15 Actions Plans on optimizing business–processes, including automating, have been developed. Thus:

            a) on e-government portal the following electronic services have been implemented:

1) Assignment (duplicate output) of social individual code

2) Output of information on receipt and movement of means of a contributor of accumulative pension fund

3) Output of references to unemployed citizens.

            b) at the present time pilot of rendering the following types of electronic services has been launched:

1) Output of referrals to persons to be involved in active forms of assistance to employment;

2) Assignment and payment of social payments to certain categories of citizens in need according to decisions of local executive bodies;

3) Registration of unemployed citizens;

4) Assignment of childbirth and childcare benefits (regarding childcare).

            c) tested on test database: 

1) Assignment of state basic pension payment;

2) Assignment of state social old age benefit. It is prepared to make changes in RLA.

            d) Partial automation of 8 public services of the Ministry (optimization) has been carried out.

Thus, technically on e-government portal completely automated in 2011 - 2 e-services, in 2012 – 6 e-services and 8 optimized services.    

7. Purchases of computers – due to recognition of competition failed, purchases have been carried out from one source, contract No. 133 dated 31 July 2012 was signed with ALSI LLP in the amount of 82 793.9 thousand KZT. Goods are delivered on 3 October 2012, the contract is executed by 100%, share of Kazakhstan costs - 0%.

Procurement of services on the development of AIS SCPP and Unified information system of social and labor sphere with rendering services in the scope of implementation of “State program of formation and development of national information infrastructure in the Republic of Kazakhstan in 2011-2013” – owing to recognition of the competition failed, purchases have been carried out from one source, contract No. 140 dated 12 September 2012 was signed with Business Applications Solutions LLP in the amount of 231 000 thousand KZT. The contract is fulfilled to 156 000 thousand KZT.

According to 011 budget program “Services on providing pensions and benefits”, 392 536 thousand KZT was spent for the support of SCPP information systems and technical support of equipment, share of Kazakhstan costs was 100%.

Ensuring Kazakhstan costs in public purchases of ICT equipment according to the competitive request in 2012 made up:

            a) in IT services – 100%;

            b) in the volume of packaged (license) software - 0%;

            c) in the volume of IT equipment sector – 0%;

8. Taking into account opportunities of the MLSPP RK in the current year there is no need to apply “IT outsourcing”.

 

 

 

 

Improving the quality of services rendered by the Ministry lower organizations

 

 

    

 

1. To ensure professional development of employees of CSPC territorial departments, SCPP branches concerning the development of social and labor sphere on the basis of RSE “Advanced training courses for MLSPP employees”

1. Professional development of employees of territorial subdivisions of MLSPP, SCPP branches concerning the development of social and labor sphere on the basis of RSE “Advanced training courses for MLSPP employees” is carried out according to the plan.

2. In the scope of the Program of operations on interstate standardization, 2010-2012, reissue of standards according to State standards is being carried out, in this regard on the ground of expert conclusion of RSE “Kazakhstan Institute of Standardization and Certification” it is found to be unreasonable to develop earlier planned standards in the field of labor security and protection which developer is the RSRILP. In this regard, the question on amendments to the strategic plan of the Ministry is under consideration.

3. RSE State Center for Pension Pensions of the MLSPP RK completely provided social payments from republican budget. Processes of assignment of pension and social payments have also been automated.

4. According to resolution of the RK government dated 20 March 2012 No. 345 “On reorganization of joint-stock companies “Almaty Prosthetic and Orthopedic Center”, “Petropavlovsk Prosthetic and Orthopedic Center”, “Semipalatinsk Prosthetic and Orthopedic Center”, Actions Plan, its implementation resulted in creation JSC Republican Prosthetic and Orthopedic Center (certification of state registration dated 15 August 2012 No. 1658-1910-02-AO). 

5. Action to create PI “Republican medical-social expert commission” is excluded from the strategic plan of the Ministry.

6. Provision of information and analytical services on employment problems, labor legislation and social protection of population by RSE “Information and Analytical Center” is provided in accordance with the established procedure.

 

 

Staff assistance

1. To follow strictly the RK legislation on civil service (including the principle of gender equality) in selecting and placing personnel, managing official career.

-       training, professional development and retraining of civil servants;

1. In order to increase effectiveness of the MLSPP activity on human resource management, MLSPP RK Plan on enhancing the system of personnel management, implemented within established period,  was created and approved by order of senior secretary No. 249-o-m dated 25 June 2012.

2. The Ministry of Labor and Social Protection of Population of the RK continues to monitor and control the status of implementation practice by electronic “Reminder” set to all personnel of the ministry. In 2012 the MLSPP received 35 358 documents.

Each structural subdivision, according to the list of  controlling documents according to acts and orders of superior state bodies, has officials responsible for high-quality execution and implementation.

In 2012 6 departments were monitored on following the regulated requirements and its timely execution, reference on the results of monitoring was provided to senior secretary.

Also continuous monitoring of controlling documents of PA and PMO is carried out on SBIP service “Reminder on execution of controlling order of PA and PMO RK to state bodies”.

3. According to the approved plans of professional development and retraining of personnel of the central apparatus of the ministry and CSPC territorial bodies in 2012 429 employees were trained, including:

1) professional development – 369, among them the CA MLSPP RK - 37; CSPC territorial bodies -332.

2) 60 had retraining, among them the CA MLSPP RK - 3; CSPC territorial bodies - 57.

110 employees completed courses to learn state language, the English language - 15 employees of central apparatus of the ministry and CSPC territorial bodies, CA and CSPC.

According to the results of certification in 2012 in central apparatus, 6 people have been recommended to personnel reserve for higher positions, among them within a year 2 persons have been appointed to higher positions.

Personnel reserve of the Ministry is formed in the section of structural subdivisions. Rules of trainings for employees of territorial bodies in the Ministry (order of senior secretary dated 19 June 2012 No. 240-o-m) have been developed and approved.

From departmental personnel reserve for the reporting period, 4 employees have been appointed, 14 employees of territorial bodies had training in the Ministry.

In 2012, 67 persons have been appointed to higher positions according to the order of career promotion.

Bonus for workers is given according to the results of carried assessment. According to the results of assessment of civil servants job in 2012, the average value made up 3.88.

At year-end the workers, reached greatest results at work, have been awarded and rewarded.

Within 2012 44 employees have been assigned on directions "center-region", "region-center".

4. HR department of the Ministry of Labor and Social Protection of Population of the RK on a constant basis renders methodological help to employees of HR departments of CSPD territorial bodies and lower organizations.

5. Proposal on implementation of “e-personnel” information system was rejected by the MTK RK as implementation of “e-personnel” information system in all state bodies are scheduled by the ACSA RK in 2014. In this regard the strategic plan of the Ministry had amendments to exclude the action.

 

 

Material support

To develop material basis of the Ministry, its subdivisions and lower organizations in order to support continuous work and optimization of administrative expenditure.

In 2012:

- according to 014 program “Capital expenditure of the Ministry of Labor and Social Protection of Population of the Republic of Kazakhstan”, purchasing of: computing and office automation equipments - 1 836 units, office furniture - 341 units, intangible assets - 472 units and general overhaul was made in 2 buildings.

- according to 015 program “Capital expenditure to organize social protection on the republican level”, RSE “Republican Center of Experimental Prosthesis” spent 914.3 thousand KZT and purchased 10 units of computing and office automation equipments, 31 units of furniture; RSE “Republican Scientific and Research Institute on Labor Protection” spent 17 501.1 thousand KZT and  purchased 77 units of computing and office automation equipments; RSE “State Center for Pension Payment” spent 530 167.8 thousand KZT and 1 154 units  of computing and office automation equipments and 3 000 units of intangible assets; PI “Advanced Training Courses of Personnel” spent 205.4 thousand KZT and purchased 3 units of computing and office automation equipments.

 

 

Financial security

1. To take measures of preventive monitoring, timely identification, analysis and assessment of potential risks in financial security of the Ministry activity.

2. To enhance personal responsibility of heads of structural subdivisions of the Ministry and its lower organizations for effective spending of budget funds.

3. To control finance and assets using information system of Treasury of the Republic of Kazakhstan.

1. With aim to take measures of preventive control, timely identification, analysis and assessment of potential risks in financial security of the activity of the Ministry, the following measures are held on a monthly basis:

1) monitoring of execution of budget programs (subprograms) for the respective reporting period according to the approved individual plans of financing by public institutions of the MLSPP RK and submitting information to the Ministry executives;

2) submitting of general “Report on the results of monitoring of implementation of budget programs (subprograms)”, “Execution of republican budget development programs for 2012, intended for implementing investment projects” in the MF RK within the first 10 days of a month;

3) forecasting of expected execution on social payments until the end of the current year on the ground of actual data;

4) monitoring of actual execution by local executive bodies (hereinafter referred as LEB) of target transfers based on the ground of LEB data; 

5) submitting of information to public purchases web portal under the signed and executed contracts to form 1PP report, the report on Kazakhstan costs.

2. For the purpose of target and effective use of means, and also achieving direct and final result which shall be reached by using target transfers allocated by LEB, the Ministry and Akims of respective regions concluded Agreements on the results of target transfers, and also signed trilateral credit contracts according to 019 program “Crediting of regional budgets, budgets of Astana and Almaty to support entrepreneurship development in village within the Employment 2020 program”.

In the result of taken measures budget execution for 2012 made up 99.98%.

For effective management of budget funds, in February and October 2012 the Ministry made proposals to budget specification for 2012, accepted by RK Laws dated 16 March 2012 No. 6-V and 20 November 2012 No. 51-V LRK “On amendments and additions to the Law of the Republic of Kazakhstan “On the republican budget, 2012-2014”.

3. Treasury department of the MF RK in Astana carried out modernization of Treasury-client system, the program was installed in 2 May 2012, at the present time accounting service operates in Treasury-client system.

Strategic direction 1. Promoting the growth of the labor force

Social security and social insurance

Currently, the country has a multilevel model of the social security system, which substantially conforms to the principles of market economy and providing for allocation of responsibility for social security between the state, employers and employees on the basic, compulsory solidarity and voluntary levels.

In 2012, worked to improve the social and pension payments:

In 2012, 4 pilot regions (Astana, Eastern Kazakhstan, Pavlodar and Kostanai region) introduced a new mechanism for optimizing the delivery of social payments to certain categories of citizens, which provides for increased social support depending on the resources and capabilities of applicants to receive it, redistribution and direction of social assistance to the most needy. In this regard, be amended accordingly to the Law "On local government and self-government in the Republic of Kazakhstan." In the implementation of the law developed Model Regulations social assistance, adjust the size and determine the list of certain categories of citizens need to align to state authorities.

In preparation of proposals for the improvement of methods for determining the minimum subsistence level in 2012, completed two studies, involving national and international experts.

Measures taken to improve the welfare of citizens is also influenced by the following dynamics of income inequality. Nominal income per capita in November 2012 were at the level 51738 48435 KZT against the same period in 2011 and increased by almost 7%. Proportion of population with incomes below the subsistence minimum in 3 quarter 2012 was 4% (urban areas - 1.9%, rural - 6.5%) compared to 5 % in Q3 of 2011.

 

Work of the Ministry of the fourth direction is presented in the strategic plan of 3 target indicators and 18 indicators of direct results.

 

By the end of 2012 to the fourth direction achieve three target indicators and 16 indicators of direct results, the two indicators of direct results according to preliminary data the degree of achievement was more than 98%.

 

Strategic Direction 5. Formation of an effective system of social support for vulnerable populations.

Provision of special social services

In accordance with the Law "On special social services" is a reform of social care services in stages in the public, private and non-governmental sectors implemented standards for the provision of special social services in a hospital environment, polustatsionara and home care.

In the past year, the social order to provide of special social services has been implemented in 12 regions of 52 NGOs covering two thousand people.

In 2012, four pilot regions - East Kazakhstan, Kostanai region, in the cities of Astana and Almaty was introduced standard provision of special social services in the area of ​​social protection of the population in conditions of temporary stay, comprising administering to a new category of coverage of social services - persons without a fixed residence (approved by Government Resolution № 214 of 10 February 2012).

Total system providing of special social services reached more than 78,000 elderly and disabled, including children with disabilities.

In general, the implementation of the Law "On special social services" from the national budget in 2012 was sent to the local executive bodies 2.1 billion.

On social protection of disabled

  In 2012, work continued on the creation of conditions for the ratification of the UN Convention on the Rights of Persons with Disabilities and its Optional Protocol.

January 16, 2012 Government Resolution № 64 approved the first phase (2012-2013) of the Action Plan to promote the rights and quality of life of persons with disabilities in the Republic of Kazakhstan for 2012-2018 (hereinafter - the Action Plan).

As part of this plan:

in the unification of the existing legislation: the Concept of the draft Law of the Republic of Kazakhstan "On amendments and additions to some legislative acts of the Republic of Kazakhstan on protection of rights of persons with disabilities" (hereinafter - the Draft Law); inventoried 32 normative legal acts (approved proposals for changes and additions 24 normative legal act, which affected 85 standards);

in terms of assessing the status of accessibility of facilities and services in key areas of life of persons with disabilities : for local executive bodies aimed Guidelines for inventory (certification ) of social infrastructure for compliance with an accessible environment for disabled (approved by joint order of the MLSP of RK (from 18.08.2012 year number 328 - m) and Chairman from 17.08.2012 , № 413) , and developed in a joint project with UNDP 250 collections regulations and state standards on accessibility issues objects in the main areas of disabled persons ; inventory of the objects local executive bodies (of 11 thousand objects scheduled for certification, pass ported 7035 objects , of which the object to be adapted 5324);

adopted and implemented jointly with the Ministry of Culture and Information Order "On Approval of the media plan to conduct public awareness campaigns, publications and presentations in the media aimed at creating positive attitudes towards disability."

 

Work of the Ministry of the fifth direction is presented in the strategic plan target indicators 3 and 7 indicators of direct results.

 

By the end of this year 2012 the fifth direction ensured the achievement of two target indicators and 7 indicators of direct results, the extent to which a target indicator was more than 98% (98.5%):

- Target indicator "Proportion of rehabilitated disabled (on the number of re-examine the disabled), including full rehabilitation." The degree of his achievement is 99.1%. This was due to the following reasons:

a) low rehabilitation potential of persons with disabilities, in which an increase in the number of disabled groups 1-2. For 2011 the severity of disability (percentage of people with newly recognized first and second group) was 64% for 2012 - 67.5%.

b) changes in legislation earlier this year entered into force on Government Resolution № 1241 of 31.10.2011, "Regulations examination temporary disability issue sheet and certificate of temporary disability," according to which, healthcare organizations have the right to extend (without the ITU ) sick leave for long periods (up to restore health). If you have previously sent patients with injuries to the ITU to establish disability (after a certain time after rehabilitation, they rehabilitated), the patient is currently on a sheet of disability to complete rehabilitation. Only in case of severe disease, impossibility of restoration of disturbed functions of the patients is sent to the ITU.
