"On draft Law of the Republic of Kazakhstan "On ratification of Agreement on common principles and rules for drug circulation within the framework of Eurasian economic union"

On December 23, 2014, in Moscow there was held the meeting of the Council of Eurasian economic commission (hereinafter – Commission) where the Agreements were signed to determine the common principles and rules for circulation of drugs and medical products (medical devices and medical equipment) within the framework of Eurasian economic union (hereinafter – Agreements) according to articles 30, 31, 100 of Eurasian economic union treaty.

These Agreements establish the common principles and rules for circulation of drugs conforming to the standards of appropriate medical practices and medical products conforming to the requirements of management of the medical product quality on the territory of member countries of Eurasian economic union.

To implement Agreements the Commission develops 25 statutory legal acts in the sphere of circulation of drugs and 15 statutory legal acts in the sphere of circulation of medical products.

The Agreements together with statutory legal acts of the Commission will enter into force since January 1, 2016.

According to subparagraphs 2), 8) of article 11 of the Law of the Republic of Kazakhstan "On international treaties of the Republic of Kazakhstan" dated May 30, 2005, the Agreements are subject to ratification.

Adoption of the Law of the Republic of Kazakhstan On ratification of the Agreements does not contradict the national legislation of the Republic of Kazakhstan and contributes in strengthening population health in the member countries by means of ensuring availability of safe, effective and high-quality pharmaceutical products and medical products via taking measures required for harmonization of the member states' legislation in the sphere of circulation of the drugs and medical products.
