In the course of two-day working trip to Almaty the Minister of healthcare and social development of the RK Tamara Duisenova had meetings with the citizens and personally explained the standards of new Labor Code of the RK, told about changes in the system of civil servants' remuneration, about new State program of development of healthcare of the RK "Densaulyk" for 2016-2019 and social security.
Today at the meeting with labor collectives Tamara Duisenova explained the main standards of the new Labor Code of the RK signed by the Head of State on November 23 of the current year.
"The state will establish the minimum labor standards of guarantees and remunerations to workers and provide rigid control over their execution by employers. Relations between the employer and workers will be built mostly on the principles of self-regulation, with strengthening the potential of collective negotiations and the agreements concluded between them in such spheres as hiring, personnel movement and dismissal of workers, working hours, conditions and payment of their work", - she reported.
The Minister reported that for employers the procedures of hiring, personnel movement, and dismissal, establishing the conditions and remuneration of workers are simplified. At that basic labor guarantees and the rights of workers with possibility of their expansion through the signed individual, collective contracts and agreements, and also instruments of protection of their rights and interests are affirmed. The role of labor unions in ensuring the rights and interests of workers, including taking into account the opportunities provided in recently adopted law "On Labor Unions" is expanded.
The main innovations provided for in the Labor Code are:
1. Simplification of procedures for changes in terms and conditions of the employment contract, especially in the situation of the crisis phenomena in economy.
This novel provides for creating such conditions when it is easier for the employer to introduce the regime of part-time and temporary appointment of employee to other work instead of cutting their number.
2. The ground for the employment contract termination at the initiative of the employer at "decrease in output, the performed works and the rendered services which caused deterioration of an economic condition of the organization" is entered.
The employment contract termination shall be possible at simultaneous observance of the following conditions:
- closing of structural division (shop, site);
- lack of possibility to appoint the worker to other work;
- the written notice of labor union not less than in one month before with the indication of the economic grounds forming the basis for employment contract termination.
At terminating the labor relations on this basis compensation at a rate of two-month salary is paid to employees.
Besides, it is proposed to grant the employer with the right to terminate the employment contract with the employees who reached the retirement age established by the legislation of the RK upon explicit regulation of the termination procedure. At that it is provided for possibility of annual extension of the employment contract with the worker who reached retirement age and possessing high professional and qualification level taking into account its working capacity (by analogy with the public and civil servants).
3. The employers are entitled to establish the trial period to any categories of workers.
This innovation is conditioned by existing prohibition for employers to establish the trial period for the persons under 18 years, persons with disabilities, graduates of higher education and VET institutions who start their work for the first time. This prohibition does not promote employment of the citizens belonging to these categories as employers, as a rule, do not employ them.
4. It is provided for introduction of integrated approach to the solution of issues concerning employment of the persons with disabilities.
The Law "On population employment" adopted by the Parliament of Kazakhstan on November 5 of the current year provides for establishing the compulsory for employer quota for employment of the persons with disabilities at the rate of 2-4% of total number of employees with creation of special workplaces. At that it is proposed to subsidize the employer's costs for necessary equipment of a special workplace of the persons with disabilities at the expense of the state.
In its turn the Labor Code provides for preservation of prohibition to involve the persons with disabilities in overtime works. Standards for applying the summarized accounting of working hours and the reduced working hours (no more than 36 hours per week) remain unchanged.
5. In relation to issues concerning the employees remuneration the draft Code contains the provision that the employer independently (by adoption of the employer acts) or on initiative of the workers' representatives (by means of the collective agreement conclusion of the) shall solve the issue on selection of the form, system and rates of the workers' salary.
Thus, the employers and representatives of workers are entitled to regulate the amount of remuneration for works at night, in days off and holidays, and also in the overtime mode through the labor and collective contracts. At that the remuneration over the established time standards should not be less than one-and-a-half size of the main rate.
6. To strengthen the public control sphere it is entered the institute of technical inspectors from among the workers nominated by labor union and to provide their powers within the framework of production councils on labor protection and safety created on a parity basis.
At the meeting with workers of the budgetary sphere the Minister told Aktobe citizens about introduction since January 1, 2016 of new model of system for remuneration of civil servants which provides division of positions of civil servants into four categories depending on education, qualifications, complexity and degrees of responsibility of the performed works:
block A - responsible for strategy of organization development and making administrative decisions; block В - block of the main personnel providing realization of the main functions of the organization; block С - carrying out administrative and legal and economic functions; block D – auxiliary personnel realizing support and technical functions.
As a result of introduction of new model of remuneration system differentiated salary increase for workers of the main personnel depending on qualification expected:
- in health sector is from 7% to 28%;
- education is from 15% to 29%;
- other spheres is from 28% to 40%.
At that the increase in salary will be differentiated, depending on education level, qualification, length of service of the worker, etc.
At the meeting with healthcare workers the Minister explained new State program of development of healthcare of the RK "Densaulyk" for 2016-2019, the main objectives of which are: development of public healthcare system, improvement of disease prevention and management, increase in effectiveness of managing and financing the healthcare system, ensuring the rational use of the resources and infrastructure optimization. Core goal of the program is to achieve by 2020 the life expectancy of the Republic of Kazakhstan population being 73 years.
Tamara Duisenova informed that within the framework of this program the system of public healthcare will be created on the basis of integration of epidemiological service and service of healthy lifestyle formation and nutrition rationalization.
In arrangement of medical care the central core will become the primary medical and sanitary care (hereinafter - PMSC) within which the stage-by-stage increase in the list of medicines for free out-patient treatment is planned. Universality of PMSC will be provided by further transition to the family principle of service (hereinafter - FPS) providing supervision over health of the person during all his life taking into account features of the organism in each age period with emphasis on prevention. FPS will be carried out by general practitioners or multi-disciplinary teams from among currently working district doctors (therapists, pediatricians, gynecologists), depending on personnel completeness of the concrete region.
With increase in number of the general practice doctors and growth of their competence they will replace multi-disciplinary teams.
Further development of transport medicine, including sanitary aviation, emergency medical care and telemedicine, network of mobile pharmaceutical units is also provided.
Specialized medical care will be integrated with all healthcare services. At that development and implementation of the special plans of action on the main socially important, noninfectious diseases and diseases significantly influencing the country population demography is provided: acute myocardial infarction, acute cerebral vascular incident (insult), malignant neoplasms, injuries, pregnancy and obstetric aid. In each direction there will be rendered all cycle of services: prevention, medical measures, including rehabilitation, dispensary observation, medical and social services.
Along with that, development of highly qualified special medical care with involvement of the best world practices will proceed.
In order to solve issues concerning quality, safety and availability of the medicines provided to the population the Kazakhstan national drug formulary will be developed (hereinafter - KNDF) until the end of 2015. The British national drug formulary which is considered in the world as "the gold standard" is taken as the basis of KNDF.
KNDF will include all list of the medicines registered in Kazakhstan, information on their proved clinical efficiency, on possible bad effects and the limit price for each preparation. Thus, it will become the big reference book, both for doctors, and for citizens of the country.
To ensure financial sustainability of healthcare system the mandatory social medical insurance will be introduced in Kazakhstan since 2017. The state will execute payments for 15 categories of citizens (social and vulnerable segments of the population). Employers will pay for hired workers. The workers and self-employed citizens registered in tax authorities will pay for themselves.
Rates of contributions will raise stage-by-stage: for the state from 4% in 2017 up to 7% in 2024, for the employer from 2% in 2017 up to 5% in 2020, for the worker from 1% in 2019 up to 2% in 2020, for self-employed citizens (individual entrepreneurs, private notaries, private judicial performers, lawyers, professional mediators, natural persons gaining income under contracts of civil character) from 2% in 2017 up to 7% in 2020. Contributions for employers will be attributed to deductions at calculation of corporate income tax, for workers and self-employed citizens - at calculation of individual income tax.
On November 27 Tamara Duisenova will hold the meeting devoted to issues of employment with participation of deputy akims of oblasts and cities, representatives of oblast administration of employment coordination and social programs.
At the meeting with veterans, persons with disabilities, pensioners and representatives of non-governmental organizations the Minister will make explanations concerning providing special social services, and also assignment and payment of the state social benefits for disability and in case of the breadwinner loss.
So, since January 1, 2016 the sizes of the above benefits will be increased by 7% due to change in size of minimum subsistence level.
Besides, in fulfillment of the order of the Head of State sounded in the Message to nation of Kazakhstan date January 17, 2014 "Kazakhstan way – 2050: Common goal, common interests, common future", since January 1, 2016 the sizes of these benefits will be increased by 25%.
Let us remind, on November 10-11, Tamara Duisenova held explanatory campaign in Astana, on November 12-14 – in Almaty, on November 15-16 – in Shymkent. At the beginning of December the Minister will visit Pavlodar.
