In accordance with Article 133 of the Labor Code of the Republic of Kazakhstan the employer is required at their own expense to pay workers a social benefit for temporary disability.
The basis for payment of social benefits for temporary disability is sick leave.
Social temporary disability benefits paid to employees from the first day of incapacity until the day of rehabilitation or to the establishment of disability in accordance with the legislation of the Republic of Kazakhstan.
According to paragraph 1 of the Resolution of the Republic of Kazakhstan dated December 28, 2015 № 1103 "On determination of the amount of social benefits for temporary disability, "the size of social benefits for temporary incapacity for work (hereinafter - the Manual) workers, with the exception of active participants, invalids of the Great Patriotic War and persons equated to them, is determined by multiplying its average daily wage in the number of working days, relating to the period of temporary disability.
The size of the benefit payable in one month may not exceed fifteen times the value of the monthly calculation index during the year, except for the level of benefits paid to employees in connection with the industrial injury or occupational disease, working participants, invalids of the Great Patriotic War and persons equated to them, as well as the diplomatic service staff receive benefits in foreign currencies during the period of stay abroad .
The size of the average daily wage of the employee is determined on the basis of his average salary calculated according to the order Minister of Health and Social Development of the Republic of Kazakhstan dated November 30, 2015 № 908 "On Approval of the Uniform Rules for calculating the average wage" (hereinafter Rules).
