Today, during the plenary session of the Majilis of the Parliament of the Republic of Kazakhstan, the draft Law of the Republic of Kazakhstan "On Ratification of the Agreement on the Procedure for Investigating Work Accidents Occurred with Citizens of One Member State of the Eurasian Economic Community in the Conduct of Labor Activities in the Territory of Another Member State of the Eurasian Economic Community" further - the Agreement).
The agreement is aimed at mutual protection of labor rights of citizens of the Republic of Kazakhstan, the Russian Federation, Belarus, Kyrgyzstan and Tajikistan, who suffered from accidents at work.
The ratification of the document presupposes the consolidation of the procedure for investigating accidents at work with citizens, including those who are self-employed and also employed by the enterprises of these countries.
According to Madina Abylkasymova, Minister of Labor and Social Protection of the Republic of Kazakhstan, according to the norms of the agreement, the procedure for investigating accidents at work is established in accordance with the legislation of the state of employment.
At the same time, the Agreement provides for a uniform for the member countries form of the act on the accident at work No. H-1E, which at the end of the investigation the employer is obliged to issue to the employee, with one copy of the certificate sent to the State Labor Inspectorate of the State of Employment.
Documents issued in connection with the investigation of an accident or their certified copies issued in the territory of one of the participating countries are accepted by other countries parties to the Agreement without legalization.
Thus, for the affected citizens, the process of further compensation for harm to health and obtaining compensation payments related to accidents at work is greatly simplified.
Compensation for damage to the health of the employee, is made in accordance with the legislation of the State of employment.
The agreement does not contradict the Constitution of the Republic of Kazakhstan, the norms of labor legislation, in particular, the Labor Code of the Republic of Kazakhstan and the international treaties adopted, and will not require additional financial expenses from the republican budget.
